A question on copyright.

No doubt, anyone who has looked at enough lures will start to see similarities between certain manufacturers. I know a lot of the Aussie lure makers have worked together and co developed some lures, that they will then market individualy (maybe different names, colours, bibs). there are of course some lures that are straight out copies, some with permission and some without. We've all seen nilsmaster spearhead, rebel crawdad, and deception nipper copies (i have no idea whether or not these were done with or without permission.
But I saw something in my travels the other day that I found particulurly disturbing. A tackle shop had repackaged another brands lure in its own design bag and was selling them as there own product. It was one of the soft plastic lures that come pre molded around its own hook and weight, they are normally packed in multiples. In this case the tackle shop had repackaged them individually and was selling them at an increased price (with no refferance to the original manufacturer. I have no doubt as to the original product as I use them alot, and they would not be reproduced easily in such detail.
Is this legal?
It would be no different to me buying my favourite hardbody repackaging it and selling it at a higher price.
I don't want to contact the distributor of this particular product (we are all very familiar with the name) or identify the shop until I'm sure of the legalities. I'd hate to bad mouth someones business if they were doing this with permission.


Any comments or similar examples anyone?

I saw a lot of stores do that... the usual excuse when I ask is that people don't want to buy the larger qty so they repackage the smaller qty and charge for handling. I also seen them do it with jig heads, etc.
